Understanding Condominium Urban Town Purchases in Ontario

How condominium tenure works for townhomes in Ontario: the declaration, common expenses, the disclosure statement and the statutory protections buyers have.

Countryside Urban Towns is published as a condominium community. If your previous purchase was a freehold house — or nothing at all — the condominium layer is the part worth learning before the release, because it shapes both your monthly cost and your rights as an owner.

What condominium tenure means for a townhome

Ontario condominiums are created under the Condominium Act, 1998. You acquire ownership of your unit, plus a proportionate interest in the common elements, and you become a member of the condominium corporation that manages them. The declaration and description define exactly where your unit ends and the common elements begin — and for townhomes, that boundary varies more than people expect. In some communities the roof and exterior walls are common elements; in others, portions are exclusive-use.

Common expenses

Owners pay monthly common expenses set by the corporation's budget. They typically fund management, insurance on common elements, exterior and landscape maintenance, snow clearing of shared areas, and contributions to the reserve fund that pays for major repairs and replacement over time. The first-year budget appears in the disclosure statement.

The disclosure statement

For a new condominium, the declarant must deliver a disclosure statement to the purchaser. It is the single most informative document you will receive. Expect the proposed declaration and by-laws, the budget statement for the first year including estimated common expenses, information about the reserve fund, and details of any commitments or restrictions.

The 10-day rescission period

Ontario gives purchasers of a new condominium unit a ten-day rescission period. It runs from the later of the day you receive a copy of the executed agreement of purchase and sale and the day you receive the disclosure statement, and it lets you cancel without penalty within that window. Material changes to the disclosure statement can trigger a further right. Use that window for a real legal review, not a skim.

Warranty protection

New homes and condominiums in Ontario are covered by the statutory new home warranty programme administered by Tarion, with builder licensing overseen by the Home Construction Regulatory Authority. Coverage includes deposit protection and defined warranty periods; common elements in a condominium are warranted as well as the units.
